Dr. Bradley Foerster and Dr. Myria Petrou Document More Than Two Years of Unsuccessful Efforts to Trace Bank of Ann Arbor's $1.4 Million Sheriff's Sale Credit Bid
For more than two years, Dr. Bradley Foerster and Dr. Myria Petrou have worked to trace the disposition of Bank of Ann Arbor's approximately $1.4 million credit bid made at the August 3, 2017 sheriff's sale involving their three Ann Arbor properties, including 630 Geddes Ridge Avenue. The effort began after their accountant reviewed the Bank's loan documentation and advised that the sheriff's sale proceeds should be traced to ensure that all proceeds could be fully accounted for and to exclude the possibility that any unaccounted-for funds had been diverted or used for an unauthorized or unlawful purpose.
Over the next two years, Dr. Foerster and Dr. Petrou repeatedly sought records from Bank of Ann Arbor sufficient to trace the disposition of the sheriff's sale credit bid and determine whether the Bank maintained records explaining its accounting treatment. During that review, the Bank's loan transaction history reflected an approximately $1.4 million credit bid, a subsequent $1,151,261 principal reduction, and a $294,675.65 charge-off. Although those entries accounted for the outstanding loan balance, no Bank record was produced explaining how the credit bid was applied or identifying any third-party payments, transfers, disbursements, settlements, or other transfers of value associated with those transactions. Requests to meet with Bank representatives to discuss those accounting issues were also made but were not accepted.
In May 2026, the inquiry shifted to formal Requests for Information submitted pursuant to RESPA and Regulation X. Following those requests, Bank of Ann Arbor began providing written responses concerning the issues raised. During that correspondence, the Bank advised that it did not maintain a reconciliation worksheet, reconciliation document, or comparable accounting record reconciling the sheriff's sale credit bid to the subsequent accounting entries reflected in the loan history. The Requests for Information were then narrowed to seek identification of any existing Bank records reflecting third-party recipients of money or other transfers of value associated with those transactions. In its final two responses, the Bank stated that the requested information had either already been provided or did not exist within the Bank's records and advised that it considered the matter closed.
Accordingly, the June 30, 2026 documentation package published below was prepared to preserve the documentary record developed during that two-year effort. The package consists of the documentation letter transmitted to Bank of Ann Arbor, the executed affidavits of Dr. Bradley Foerster and Dr. Myria Petrou, and the supporting exhibits. Together, those documents preserve the documentary record developed over more than two years, memorialize the Bank's stated positions, and document the factual basis for the effort to trace the disposition of the August 3, 2017 sheriff's sale credit bid.
