Supplemental Exhibit Filed After Revised May 15, 2026 FBI Production Date Passes Without Production

Following the FBI’s missed May 4, 2026 anticipated production date in Foerster v. U.S. Department of Justice, Plaintiff Dr. Bradley Foerster filed a Motion to Compel Production and Request for In Camera Review on May 6, 2026.

A subsequent Joint Status Report filed May 12, 2026 represented that the FBI anticipated making productions on or about May 15, 2026 and June 16, 2026, and further confirmed that the FBI had identified approximately 522 pages of potentially responsive records together with potentially responsive audio records.

On the evening of May 15, 2026, after no FBI production had been received by the revised anticipated production date, Dr. Foerster transmitted the following email to Assistant United States Attorney Kimberly Stratton concerning the status of production.

On May 16, 2026, Plaintiff Dr. Bradley Foerster subsequently submitted the foregoing email correspondence to the United States District Court for the District of Columbia as a Supplemental Exhibit in the pending FOIA litigation.
