United States Attorney's Office Reports No Records Under Grant-Focused Subject; New FOIA Seeks Complete HHS-OIG Matter

On July 15, 2026, the Executive Office for United States Attorneys (EOUSA) responded to Dr. Bradley Foerster's Freedom of Information Act request. EOUSA identified the subject of the request as:

“NIH Grant R01NS082304 – documenting the United States Attorney's Office's evaluation, review, and disposition.”

EOUSA further reported that a search of records located in the United States Attorney's Office for the Eastern District of Michigan revealed no responsive records “regarding the above subject.”

By comparison, the August 21, 2019 HHS Office of Inspector General Closing Investigative Memorandum identifies HHS-OIG Case No. 5-17-0-0192-4 and states that discussions with the Office of the United States Attorney resulted in a declination of criminal prosecution.

Following receipt of EOUSA's response, Dr. Foerster submitted a new Freedom of Information Act request clarifying that the records sought concern the entire matter identified in the HHS-OIG Closing Investigative Memorandum, rather than records concerning NIH Grant R01NS082304 or any grant-related issue.

The new request uses the HHS-OIG Closing Investigative Memorandum as the identifying document for the matter and seeks records concerning the United States Attorney's Office's evaluation, review, handling, and disposition of that entire matter.
