HHS-OIG FOIA Production (Senator Cardin Intervention) – University of Michigan Medical Billing Complaint and Investigative Materials
HHS Office of Inspector General records produced in response to a congressional inquiry and Freedom of Information Act appeal regarding a July 20, 2017 University of Michigan medical billing complaint (case #5-17-0-0192-4).
Notably, the opening October 6, 2017 HHS-OIG Investigative Memorandum reproduced below stated that HHS-OIG was the “sole investigating agency at this time,” a chronology point later placed in additional context by subsequent FBI records released through FOIA.
Released records reflect that the original HHS-OIG medical billing complaint later developed into an investigation involving the ALS research grant supporting the work of Dr. Foerster and Ms. Altaee.
The released HHS-OIG records include references to investigative media originating from the Ann Arbor Police Department, including an AAPD DVD identified within the responsive materials containing August 2017 “Nick” communications and related materials concerning Dr. Paul Cronin.
The January 2024 HHS-OIG release identified case number 5-17-0-0192-4 in connection with a University of Michigan medical billing complaint, allowing that complaint to be matched to the same HHS-OIG case number previously associated with the NIH ALS grant investigation.
Subsequent Development (June 2026). Records released by the FBI in June 2026 revealed that although the FBI investigation was ultimately closed and criminal prosecution declined, contemporaneous HHS-OIG records referenced grant restitution, reduction of the University's NIH letter of credit, and a debarment process. The records further reflected efforts to debar Dr. Bradley Foerster and at least one additional redacted individual from future federal grants. This information was not available when the underlying HHS-OIG materials discussed above were first released. The records do not identify all affected individuals, whether notice was provided, or what ultimately became of the debarment process.
