Letter to University of Michigan OGC's Thomas Kent and AAPD Detective Bradley Rougeau Seeks Clarification Concerning Bank of Ann Arbor Loan Account #500987 Transactions During Search Warrant Period

After Bank of Ann Arbor stated that it does not maintain a reconciliation worksheet or accounting record reconciling its reported $1.4 million sheriff's sale purchase of the Foerster and Petrou properties with subsequent loan servicing entries, Drs. Bradley Foerster and Myria Petrou submitted the attached correspondence to University of Michigan Senior Associate General Counsel Thomas Kent and Ann Arbor Police Department Detective Bradley Rougeau concerning Loan Account #500987 and AAPD Case No. 17-3517.

At the time of the August 3, 2017 sheriff's sale, Thomas Kent served as Ann Arbor City Attorney and Detective Rougeau was the lead investigator in AAPD Case No. 17-3517. That investigation, initiated following allegations of embezzlement involving Drs. Bradley Foerster and Myria Petrou reported by Dr. Petrou's mother, Maria Petrou, resulted in search warrants affecting the Bank of Ann Arbor construction loan account.

The letter seeks clarification concerning whether any approvals, authorizations, judicial orders, or other accommodations permitted transactions involving Loan Account #500987 while the account remained subject to search warrants issued in connection with AAPD Case No. 17-3517.

The correspondence references the August 3, 2017 sheriff's sale, the December 2017 sale of 1745 Brian Court, a February 26, 2018 principal reduction of $1,151,261, a March 2018 charge-off, recent Bank correspondence stating that no reconciliation worksheet exists, and prior statements attributed to Bank of Ann Arbor attorney Leroy Asher that a court order authorized disbursement of funds despite the existence of the search warrants.
