Questions for Judge Carol Kuhnke Regarding the Missing District Court File, the Loss of Our Home, and Testimony Presented in Case Nos. 17-298-AS and 17-405-NI
On June 16, 2026, Dr. Bradley Foerster and Dr. Myria Petrou transmitted the attached correspondence and supporting exhibits to Judge Carol Kuhnke concerning two unresolved issues arising from Case Nos. 17-298-AS and 17-405-NI.
Nearly a decade later, Dr. Foerster and Dr. Petrou continue to ask a simple question: What became of the procedural remedy ordered by Judge Kuhnke in 2017 after the Court was informed that no District Court file existed through which the March 13, 2017 search warrant and seizure could be challenged?
The search warrants arose from an Ann Arbor Police investigation initiated after Maria Petrou reported that approximately $434,000 had been taken from a Merrill Lynch account and attributed responsibility to her daughter, Dr. Myria Petrou. The police records further reflect that Maria Petrou and Petros Petrou cooperated with the investigation and expressed a desire to pursue criminal prosecution if criminal activity was established.
During the April and May 2017 proceedings, Judge Kuhnke expressed concern that the continuing freeze of Dr. Foerster's and Dr. Petrou's accounts was affecting their ability to live their lives and meet ordinary financial obligations, including obligations associated with their mortgage.
Despite those concerns and the Court's order directing that relief be accepted, Dr. Foerster and Dr. Petrou have never been able to identify the District Court file that was supposed to provide the procedural mechanism for review. The home was ultimately lost. By the time the matter returned to court in January 2021, the motion to enforce was denied after the City argued that the matter had become moot because no criminal charges had been filed.
The second issue concerns testimony presented under oath by Maria Petrou on September 14, 2018. Maria Petrou is the mother of Dr. Myria Petrou and the individual whose allegations helped initiate the Ann Arbor Police investigation that ultimately resulted in the execution of search warrants, the freezing of accounts, and the proceedings before Judge Kuhnke.
After later obtaining and reviewing the video recording of the September 14, 2018 proceeding in Case No. 17-405-NI, Dr. Foerster and Dr. Petrou observed Maria Petrou testify under oath that she had never accused them of embezzlement.
Maria Petrou's testimony is difficult to reconcile with the history of the matter. The allegations reported by Maria Petrou had previously led to the Ann Arbor Police investigation, the execution of search warrants, the freezing of Dr. Foerster's and Dr. Petrou's accounts, and the subsequent proceedings before Judge Kuhnke.
The letter asks how Maria Petrou's testimony should be reconciled with the police records, the investigation, the search warrants, and the litigation that followed.
The correspondence also asks why no effort was made by Dr. Foerster's and Dr. Petrou's counsel at the time, Cyril C. Hall, to address testimony that appeared inconsistent with both the pleadings and the factual premise upon which the litigation had proceeded.
