Dr. Bradley Foerster Asks Governor Whitmer Whether an Undisclosed Agreement Exists Concerning Bank of Ann Arbor’s $1.4 Million Sheriff’s-Sale Credit Bid, FBI-Referenced Restitution, and Decisions Not to Investigate — Unanswered Correspondence With Attorneys Cyril Hall and Amir Makled (October 12, 2026)
On October 12, 2026, Dr. Bradley Foerster sent a second email to Michigan Governor Gretchen Whitmer, following his earlier request that morning for identification of an independent authority to investigate Ann Arbor Police Department Case 17-3517, the Bank of Ann Arbor foreclosure and eviction of his family, and the University of Michigan's related Regents' Bylaw 5.09 proceedings.
The correspondence asks whether any undisclosed agreement purportedly made on behalf of Dr. Foerster and his wife, Dr. Myria Petrou, without their knowledge or consent, is being relied upon concerning the August 3, 2017 sheriff's-sale proceeds, restitution referenced in FBI records, or decisions by public officials not to investigate.
The question arises from two unresolved documentary issues. First, despite more than two years of requests, Bank of Ann Arbor has not provided a reconciliation of its approximately $1.4 million sheriff's-sale credit bid with the $1,151,261 principal reduction and $294,675.65 charge-off recorded in its own loan ledger. In their June 30, 2026 sworn affidavits, Dr. Foerster and Dr. Petrou stated that they did not know how the sheriff's-sale proceeds were distributed or of any superseding lien, encumbrance, or competing claim beyond the identified Bank of America mortgage.
Second, a February 21, 2019 FBI Electronic Communication states “Restitution and debarment both in process” in the context of discussions involving HHS-OIG and University of Michigan counsel. The correspondence asks what restitution was contemplated, whether any payment occurred, and whether related University accounting records exist.
The email forwards correspondence with attorneys Cyril Hall and Amir Makled, who represented Dr. Foerster and Dr. Petrou in AAPD matters. Dr. Petrou asked whether an agreement could have been arranged using Mr. Hall's signature or office without their knowledge. As of October 12, 2026, neither attorney had provided a substantive response. Mr. Makled was also a candidate for the University of Michigan Board of Regents, and Dr. Petrou asked him to seek clarification from the Regents. The forwarded correspondence separately raises unresolved questions concerning “Nick,” “Shonda,” and an individual who identified himself as HHS-OIG Special Agent “Tyson Howard.”
Neither Dr. Foerster nor Dr. Petrou has any knowledge of, or has authorized, such an agreement. The correspondence asks Governor Whitmer to determine whether an agreement purportedly made on their behalf nevertheless exists, who may have arranged it, and whether Bank of Ann Arbor, the University of Michigan, or public officials have relied upon it in connection with the sheriff's-sale proceeds, the restitution referenced in FBI records, or decisions not to investigate.
Dr. Foerster also requests a substantive response to University of Michigan FOIA Request No. 261635, concerning retroactive adjustments, clawbacks, offsets, reversals, and related accounting changes to his University salary. On June 8, 2026, the University estimated $125 in processing fees, required a $62 deposit, and provided a 75-business-day processing estimate following receipt of the deposit. The University subsequently took an additional extension.
The following four-page email contains Dr. Foerster's October 12 correspondence to Governor Whitmer and the forwarded October 8–12 exchange involving Dr. Myria Petrou, Dr. Foerster, and attorneys Cyril Hall and Amir Makled. The email references the attached June 30, 2026 Bank of Ann Arbor documentation package, including sworn affidavits on pages 26 and 28.
